Assim que sua petição I-130 é aprovada no USCIS, eles vão mandar para o NVC. O NVC vai receber seus documentos para registrar o beneficiário como imigrante e firmar um contrato com o seu patrocinador (pode ser o marido/esposa, um parente dele ou dela, um conhecido ou mesmo alguns deles juntos. Com isso eles querem garantir que o imigrante não dependerá de benefícios públicos para se sustentar nos EUA. O NVC prefere a comunicação por email, é um estágio bastante dinâmico onde na maioria das vezes é possível saber o que se passa. Os atendentes são bem frios e vão direto ao ponto, por isso, quando ligar tenha sempre seu USCIS receipt number em mãos ou o case number se já tiver recebido. Abaixo você verá quais são os passos no NVC (progresso) e em outros tópicos falarei de dois pontos cruciais: O IV packet (Immigrant Visa Packet) que diz respeito ao imigrante, nele devem ser enviados os documentos do imigrante (beneficiário), e o AOS packet (Affidavit of Support packet) que é o contrato de sustento financeiro do qual eu eu falei acima e diz respeito ao peticionário (pode também incluir outras pessoas se a renda do peticionário não for suficiente para as exigências).

1° passo: esperar uma semana após o NOA2 para ligar para o NVC e informar os emails do peticionário e beneficiário (é tempo suficiente para eles receberem seu processo), pode arriscar e pedir o case number também, às vezes sai;
Caso esteja demorando muito passarem o case number por telefone, pode mandar email para nvcinquiry@state.gov. Existem regras para envio de email, e elas são as seguintes:
- Na linha de assunto, escreva seu nome completo (beneficiário) e do lado coloque seu USCIS receipt number (considerando que você ainda não recebeu o case number);
- Comece sempre educadamente, com "Dear Sir/Madam", e peça o seu case number;
- Abaixo coloque o nome completo do peticionário e data de nascimento, depois coloque seu nome completo e data de nascimento;
- No final agradeça;

Segue um modelo do que escrever abaixo:

Após enviar o email, você receberá uma "Automatic response" com as mesmas instruções dadas acima. Eles demoram uns 3 a 4 dias para responder. Uma dica importante é: escreva e mande o email pelo navegador Internet Explorer, eu não faço idéia do porque mas às vezes eles não recebem email de outros navegadores, aconteceu comigo.

2° passo: Assim que eles liberarem seu case number, dentro de uns poucos dias você receberá o pacote AOS no email (no assunto do email diz assim: PAOSF I-130 FOR NEOPOST DS-1200). Ele vêm em um anexo em pdf, junto também vêm o formulário DS-3032 (Choice of Agent, o assunto deste é: ACL FOR NEOPOST DS-1200), juntos eu digo que você recebe quase na mesma hora, mas são emails separados. Teoricamente, este formulário serve para você preencher e escolher quem será seu agente (sim, ainda estou falando com o beneficiário), o processo será dado andamento somente após a escolha do beneficiário, uma pessoa deve ser apontada para dar andamento e realizar os pagamentos. MAS, você logicamente pode fazer essa escolha de outro modo, sem precisar usar o correio. Há uma opção de mandar um email com uma escolha eletrônica de agente, eu mesma fiz isso e foi aceita! Faça assim:
- No assunto coloque seu maravilhoso e lindo case number seguido de seu nome completo.
- Comece bem educadamente de novo com "Dear Sir/Madam".
- Eu disse assim:

Se eles aceitarem, você receberá uma resposta dizendo "Your choice of agent has been accepted" e mais alguns dizeres de prache deles.
Feito isso, é hora de preparar seus documentos para o IV packet, enquanto seu agente ou marido/esposa prepara o pacote AOS. Agora só para completar os passos, vou dizer o que se faz depois, mas explicar mesmo sobre o AOS e IV, será um um tópico específico para cada, têm detalhes que eu quero ressaltar e se misturar muita informação, fica mais difícil de entender tudo ou até mesmo de encontrar algo específico. Então vamos lá:

3° passo: O agente recebe a taxa para pacote AOS e realiza pagamento;

4° passo: Quando o status no sistema mostrar "PAID", deve-se imprimir a barcoded coversheet, ela é como um comprovante que o pagamento foi realizado, ela deve ir na frente de todos os outros documentos. Após a impressão da barcoded coversheet o peticionário prepara o AOS packet e manda pelo correio para o NVC. Após 5 dias já dá pra ligar e perguntar se foi aceito.

5° passo: Eu digo quinto só para ficar em ordem, porém você não precisa necessariamente esperar que o pacote AOS seja enviado e aceito para dar andamento no IV packet. Após a escolha do agente ser aceita, em alguns dias você deve receber a taxa para IV packet, o assunto do email é "AIVF FOR NEOPOST DS-1200". A taxa deve ser paga e o mesmo procedimento do AOS packet deve ser seguido, esperar até que o status mostre "PAID" no sistema, imprimir a barcoded coversheet e colocar na frente dos outros documentos do seu IV packet.

6° passo: O beneficiário prepara os documentos do IV packet (você pode mandar os documentos para o seu marido/esposa nos EUA e ele manda para o NVC ou você pode mandar direto, fica a seu critério), aí com tudo em ordem e conferido (assinaturas principalmente e DE CANETA PRETA), deve-se enviar para o NVC. Em poucos dias também pode-se ligar e perguntar se aceitaram ou não. Uma dica legal é usar número de rastreamento para saber quando o NVC recebeu seus pacotes, depois disso pode ligar!

Pacotes aceitos vão conferir a você o status de "CASE COMPLETE" no NVC, isso indica que seu processo foi para a fila do seu respectivo consulado e vai esperar lá até que uma data de entrevista seja agendada. Assim que isso acontecer, você receberá seu packet 4 no email com assunto "P4 FOR NEOPOST DS-1200". Nele estarão a data da entrevista, hora e instruções para o exame médico. No final também tem uma lista com o status de cada documento que você enviou, baseada nesta lista que você saberá o quê deve ou não providenciar para levar para a entrevista. Depois disso o seu caso voará para o consulado em que acontecerá a entrevista, às vezes, um pouco antes da data eles mandam um email confirmando tudo. 

Outro detalhe importante também é o payment portal. para ter acesso a ele, você deve ter seu case # e o Invoice Identification #. O IIN vêm no pacote AOS e no IV, nos pacotes também tem todas as instruções necessárias para realizar o pagamento, super tranquilo! Em tópicos particulares vou detalhar cada pacote, mas para dar um exemplo de progresso aqui vai minha linha do tempo no NVC."

First of all, to apply for a spousal visa, you should have married a U.S. citizen. A conditional resident may also apply for a spousal visa, but the most common procedure is the American citizen petitioning for alien relatives. If you have children, the U.S. citizen may also petition a visa for them yet the children do not participate in the process as dependents but as principal applicants, and it also means that the fees will be paid separately. Petitions must be assembled separately but sent together, this action facilitates the work of the immigration agency (USCIS) and your part too, since when they deal with family cases, they try to keep the petitions together, approve them together and send them together to NVC (National Visa Center) and eventually to the consulate of your country. Interviews are scheduled on the same day and children should undergo medical examination, as well as attend the interview. Given all this, the visa that will be requested for this case is the CR-1/IR-1 (Conditional Resident-1/Immediate Relative-1). If you have been married for more than 02 (two) years, NVC will put you in the IR-1 category and you should receive a Green Card valid for 10 years generally a few weeks upon entry into the U.S., you can work, study and travel with that, and after 03 (three) years of residence, should you have not caused any trouble and if everything goes on well, you can apply for U.S. citizenship (acquired by naturalization, after application of a test based on  American history). If you got married recently (less than 02 years of marriage), NVC will probably put you in the CR-1 category, and 3 months before the couple completes 02 years of marriage, you should apply for the process of ROC (Removal of Conditions). Still can work, study and travel, but will be considered eligible to apply for citizenship only after 05 (five) years.It is important to remember that any change of address should be informed so your documents are sent to the correct location. The petition that will be prepared for a spousal visa is the I-130 (Petiton for Alien Relative) and should be sent to the USCIS (you will want to check what is your office according to your American address). The average processing time is 7-8 months, but the USCIS informs on their website that it should not take more than five months for the first approval, it is a goal that was established, but difficult to achieve since the amount of petitions is high. The couple must pay attention to the evidence of their relationship. When they are together they must gather a variety of possible evidence   to support their claims, since the amount of fraud is also high. It serves photos together, with the whole family together, airline tickets, reservations and hotel bills, rental cars, facebook relationship status, exchanged emails, chat history online (messenger, facebook, yahoo, skype), wedding rings receipt, affidavits from family members stating the bona fide relationship, etc. Anything that shows the couple's love affair. Patience is the key needed since the waiting time is long and distance does not help. It took me months to fully understand the whole process, it seems quite difficult at first, but after several readings it finally sinks into your brain. IMPORTANT: This is what I sent in my file, it does not mean that EVERYBODY has to do it the same way, cases vary widely.

1) Cover Letter signed and dated;

2) Form G-1145, E-Notification of Application/Petition Acceptance;

3) Form I-130, signed just part E of the page #2 by the petitioner, don’t sign part F if you prepared the I-130 by yourself;

4) Form G-325A for the petitioner, signed by him;

5) 2 passport style pictures of the petitioner; write the petitioner’s full name in the back of the photos and put them in a ziplock bag, write the petitioner’s full name on the ziplock bag as well;

6) Form G-325A for the beneficiary, signed by the spouse;

7) 2 passport style pictures of the beneficiary; write the beneficiary’s full name in the back of the photos and put them in a ziplock bag, write the beneficiary’s full name on the ziplock bag as well;

8) Sponsor’s proof of American citizenship; it can be either a copy of the birth certificate or a copy of all passport pages (the passport is the best option); colored copies are better too. We used his passport.

9) Evidence of a bonafide marriage to support your petition;

a - Wedding certificate (certified copy provided by the courthouse)

b - Documentation showing joint ownership of property;

c - A lease showing joint tenancy of a common residence.

d - Documentation showing co-mingling of financial resources such as a joint bank account & joint tax filings.

e - Birth certificates of children born to you and your spouse together.

f - Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner or beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage.

g - Any other relevant documentation to establish that there is an ongoing marital union. While a minimum of one of the documents listed in items above may be sufficient, you are strongly encouraged to include as many pieces of documentation as you can obtain. Simply sending receipts showing that you have wired money to your spouse may not be sufficient to establish a bona fide marriage.

Note: Send only photocopies. The USCIS will request original copies if necessary (unlikely).

IMPORTANT

If any of these documents are not in English, you will need to include a translation. Anybody can do the translation.

The person doing the translation must sign their name at the bottom of the translation and state the following:

"I certify that I am competent to translate (put foreign language name here) to English, and that this is a complete and correct translation".

Beware of anyone trying to sell you "official" or "certified" translations. There is no official certification process for translations that is recognized by the USCIS. In our cases, when we had to translate documents, I did it by myself (beneficiary) and I attached the translation right after the document translated.

Now with your file full of documents and ready to go, you can send it to the USCIS. NOA1 (notice of action 1) should be received in 20 days but generally it arrives before. It means they have checked your process and at first sight, it seems everything is in order. After that you have the hardest part of the process to come, the long waiting...NOA2 can take up to 8 months to be received, but it generally comes a little bit before you can reach the 6 months mark, mine took 179 days to come (5 months and 27 days). Receiving NOA2 means you have been approved and all the documents you have sent were accepted. Your file now will be forwarded to the NVC (National Visa Center) for futher processing. I will give details on NVC progress here in another topic. These informations were related to the years of 2011-2012 (I received NOA1 on september 1 of 2011 and NOA2 on february 27 of 2012), before you get started, check on the waiting times and the right place you need to mail your petition, the right USCIS Office for you will vary according to your address in the US. My petiton was forwarded to the CSC (California Service Center), but honestly I think that during the time I was under processing, Vermont Service Center was faster. Good luck!

What Kind Of Evidence Is Submitted As Proof Of The Good Faith Marriage? - Below is a list of example of the evidence that may be submitted with the removal of condition petition. Not all such evidence required but the more documented proof you have the better easier it will be for the immigration services to approve the case. About 20 photographs traveling together, at the wedding, with family, friends etc. (a good tip is to add places, names and dates on the back of Photos.Other proof you consider relevant to establish your marriage was entered in "good faith" (such as birth certificates of children of the marriage, birthday cards, holiday cards, love letters etc.).At least 2-6 affidavits from friends/colleagues/neighbors that know both of you and have personal knowledge of your legitimate marriage and relationship "good faith marriage" (affidavits from family are good but are considered extra).
